OUTOFSOLO TERMS OF SERVICE Version 2.0 Effective date: October 2026 1. About These Terms These Terms of Service govern your use of OutOfSolo, a social discovery and dating service for adults aged 18 and over. The Service is currently operated by Serhii Pavlov, Spain. By creating an account or using the Service, you agree to these Terms. Our Privacy Policy explains how personal data is processed and is separate from these Terms. 2. Eligibility You must be at least 18 years old to create or maintain a OutOfSolo account. You must have legal capacity to enter into these Terms and must not be prohibited from using the Service under applicable law. You may not create an account for another person without lawful authority or use false information to evade a suspension, block or other safety restriction. 3. Your Account You are responsible for maintaining the confidentiality and security of your account credentials and for activity carried out through your account, except where responsibility cannot legally be assigned to you. Information you provide should be reasonably accurate and kept up to date. You must notify us if you believe your account has been compromised. We may require reasonable verification steps to protect accounts, enforce the 18+ requirement, investigate abuse or comply with law. 4. Profiles, Planets and Matching OutOfSolo allows users to build profiles and Planets using interests, concepts, preferences and other information they choose to provide. The Service may use this information to calculate compatibility, rank or recommend profiles, and provide Discovery, Search, Swipe and Perfect Match features. Compatibility percentages and recommendations are informational discovery tools. They are not guarantees of compatibility, identity, behavior, safety, relationship success or any particular outcome. You remain responsible for deciding whether and how to interact with another user. 5. Connections and Communications OutOfSolo may allow users to like profiles, send connection requests, form mutual connections and exchange messages. You are responsible for the content you send and for respecting another user's boundaries and choices. A connection, match, like or message does not imply consent to any activity outside the specific interaction provided by the Service. If another user blocks you or asks you to stop contacting them, you must not attempt to bypass that restriction through another account or method. 6. Acceptable Use You must not use OutOfSolo to: - threaten, harass, stalk, intimidate or abuse another person; - promote or facilitate violence, exploitation or illegal activity; - impersonate another person or materially misrepresent your identity for fraudulent or harmful purposes; - solicit money through fraud, deception or coercion; - distribute malware, malicious links, spam or unauthorized commercial messages; - scrape, harvest or systematically collect user data without authorization; - attempt to gain unauthorized access to accounts, systems or non-public information; - evade blocks, suspensions, rate limits or safety controls; - publish content that unlawfully infringes intellectual property, privacy or other rights; - use the Service to exploit or endanger minors; or - use automated systems to create accounts or interact with the Service without our authorization. 7. User Content You retain ownership of content you create and upload, subject to rights belonging to others. You grant OutOfSolo a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, display and transmit your content only as reasonably necessary to operate, secure, improve and provide the Service and the features you choose to use. This license ends when the relevant content is deleted from active systems, subject to reasonable technical, backup, safety and legal retention. You represent that you have the rights necessary to upload and share your content and that doing so does not unlawfully violate another person's rights. 8. Safety, Reports and Moderation OutOfSolo may provide blocking, reporting and moderation tools. We may review reports and relevant account or content information where reasonably necessary to investigate safety issues, enforce these Terms, protect users or comply with law. We may remove content, limit functionality, suspend or terminate accounts where we reasonably believe there has been a material breach of these Terms, a safety risk, fraud, unlawful conduct or misuse of the Service. Where appropriate and legally required, we may provide notice or an opportunity to challenge an enforcement decision. No online dating or social service can verify every statement made by every user or guarantee another user's identity, intentions or conduct. Exercise appropriate judgment when interacting online or meeting someone in person. 9. Privacy and Consent Personal data is processed as described in the OutOfSolo Privacy Policy. Acceptance of these Terms does not replace a separate consent where applicable law requires one. Optional analytics and designated sensitive-data processing may require separate choices. 10. Intellectual Property The OutOfSolo name, software, interface, visual design, original graphics, databases and other materials supplied by the Service are protected by applicable intellectual-property laws. Except where permitted by law, you may not copy, modify, distribute, sell, reverse engineer or commercially exploit protected parts of the Service without authorization. These Terms do not prevent lawful interoperability, security research or other activities that applicable law expressly permits despite contractual restrictions. 11. Service Changes and Availability We may modify, improve, replace or discontinue features as the Service develops. We may also temporarily restrict access for maintenance, security or operational reasons. We do not guarantee that every feature will always be available, uninterrupted or error-free. If a change materially affects your legal rights, we will provide notice where required by law. 12. Paid Features If OutOfSolo introduces subscriptions or other paid features, the applicable price, billing period, renewal terms and cancellation information will be shown before purchase. Purchases made through Apple, Google or another platform may also be governed by that platform's billing and refund rules. Nothing in these Terms limits mandatory consumer rights. 13. Account Termination You may stop using OutOfSolo and delete your account using available account controls. We may suspend or terminate access for material or repeated violations of these Terms, serious safety concerns, fraud, unlawful conduct or where required by law. Provisions that by their nature should survive termination, including provisions concerning intellectual property, legal claims and limitations permitted by law, may continue to apply. 14. Disclaimers OutOfSolo is a platform for discovery and communication. We do not guarantee that users will find a match, relationship or other particular result. To the extent permitted by law, the Service is provided on an "as available" basis. We do not make guarantees about uninterrupted availability or the accuracy of information supplied by other users. Nothing in these Terms excludes warranties, remedies or protections that cannot lawfully be excluded under applicable consumer law. 15. Limitation of Liability To the maximum extent permitted by applicable law, OutOfSolo and its operator are not liable for indirect or consequential losses that were not reasonably foreseeable when you accepted these Terms or that result from circumstances outside our reasonable control. Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability that cannot be excluded under applicable consumer-protection law. 16. Third-Party Services Some functionality may depend on third-party infrastructure or services. Those providers may have their own terms and privacy practices where you interact directly with them. OutOfSolo is not responsible for third-party services outside our control, except to the extent responsibility cannot legally be excluded. 17. Governing Law and Consumer Rights These Terms are governed by the laws of Spain, subject to mandatory rights you may have under the law of your country of residence. If you are a consumer in the European Economic Area, United Kingdom or another jurisdiction with mandatory consumer protections, these Terms do not deprive you of protections that apply regardless of the chosen governing law. Before commencing formal proceedings, you may contact us so that we can attempt to resolve the issue directly. This does not limit any right to contact a court, regulator or consumer authority. 18. Changes to These Terms We may update these Terms when the Service, our business or applicable law changes. We will identify the current version and effective date. Where a material change requires notice or renewed acceptance, we will provide it as required by applicable law. 19.
